Internal regulations of KazNMU




Internal order is defined as the procedure of conducting all kinds of classes, extracurricular lessons, educational and other activities and requirements for the maintenance on campus.
The discipline is defined as mandatory for all students discipline established in the University rules of conduct, the order of execution of training plans, programmes, attending classes, and studying the proper execution of their duties.

1.1. Each student of the University, regardless of the types and forms of education, shall:
1.1.1. Acquire knowledge, skills, practical skills and competencies in accordance with the requirements of state educational standards.
1.1.2. Take care of his/her health, to seek spiritual and physical self-improvement.
1.1.3. To maintain loyalty to the legitimate interests of the University, reasonably exercise their rights and fulfill responsibilities to the University in good faith, not to take actions that cause financial or other detriment to its interests and reputation.
1.1.4. Maintain the honor and dignity of a student of the University of their behavior, attitude to study, to raise the prestige of the University, to preserve and increase the best traditions of the University.
1.1.5. Faithfully perform contract’s agreements signed with the University for the provision of educational services, as well as other treaties and agreements.
1.1.6. To make timely payment of tuition in accordance with the agreement on the provision of educational services within 3 (three) days to provide the administration of the copy of document about payment.
1.1.7. Regularly read announcements and information posted by the University administration, International medical school at information stands in the structural units and the University library, regularly visit the official website of the University and posted on the website information.
1.1.8. To know and learn the laws of Kazakhstan and other normative legal acts, regulating the rules and procedures of teaching in higher educational institutions of the Republic of Kazakhstan.
1.1.9. To fulfill the requirements of the Regulations and other internal regulatory documents of the University for the educational processes.
1.1.10. To execute orders in the proper way, directives, orders and instructions of the University administration and the International medical school, published by them within its competence.
1.1.11. To pass all kinds of monitoring and assessment process which are established at the University to verify students academic achievements.
1.1.12. To be diligent in completing all types of monitoring progress and certification, including, to prevent cases like:
-       use informational materials, as well as technical tools of communication to obtain unauthorized information on exams, tests without the permission of the teacher;
-       falsifying identity;
-       the rating (protection), control, course, degree and other compulsory written papers, the authorship of which belongs not to the student.
1.1.13. To show faith in the learning process, including:
(a) to attend all kinds of training in accordance with the working curriculum, personal learning plan, programs and schedules of classes, not to be late for classes;
(b) in the case of absences for valid reasons, on their own or through relatives to inform the deen office) as soon as possible but not later than one calendar month from the first day of absenteeism and the first day of attendance to present the documents of the established sample (the medical certificate, agenda, explanatory notes and other), explaining the reasons for the absence.
(c) to implement in the target dates all kinds of tasks defined by the working curriculum subjects;
(d) to comply with the order of the attending of classes established in these Regulations and other internal regulatory documents of the University.
1.1.14. To liquidate the academic debt on a paid basis in the terms established by the relevant order of the Rector or other authorized officials of the University.
Note: in the case when academic debt was caused by temporary disability the student's academic debt would be work out on a free basis, provided that students of the help of VKK (medical Advisory Committee) in the prescribed form issued by the student health center.
Students transferred from other Universities are required to liquidate the academic debt in the form of differences in the program in the disciplines on a paid basis within the established deadlines.
1.1.15. Treat student personal documents (student card, record book, etc.), and in case of loss immediately report the matter to the attention of the dean office.
1.1.16. To respect the honor and dignity of the teaching staff, other employees of the University and persons studying in the University, including:
(a) stand at the entrance to the audience of teachers, employees of administration of the University;
(b) to prevent actions that hinder the normal conduct of training sessions;
(c) to prevent the use of obscene, incorrect and obscene expressions;
(d) behave with dignity, be polite and tactful, to prevent personal offence;
(e) to refrain from actions that prevent others to carry out their responsibilities.
In case of repeated such actions during educational processes that impede its normal conducting (or one-time committed in a rude or cynical form), the student may be suspended by the faculty from participation in this class, the faculty informs the administration of the International medical school directly.
1.1.17. Adhere to the established internal regulations, public order and generally accepted norms of behavior.
To prevent this, including outside of class time, activities, for which the legislation of the Republic of Kazakhstan provides for administrative or criminal liability.

1.1.1. To comply with the University access mode, including not to transfer your document, giving a right of admission to the territory and units of the University to others and not to use the document issued to another person.
1.1.2. To comply with the rules of accommodation set by hostel legislation, internal normative documents of the University and the tenancy agreement.
1.1.3. To comply with safety rules, fire safety, industrial sanitation and personal hygiene.
1.1.4. Immediately inform the University about any situations or incidents that pose a threat to the life or health of people, preservation of the property of the University.
1.1.5. To be disciplined, to maintain cleanliness and order in the territory and in the premises of the University for General use.
1.1.6. To have a sanitary book and every year to undergo a compulsory medical examination within the time and in the manner in accordance with the order the Rector or other authorized officials of the University.
1.1.7. Immediately notify the University administration about the deterioration of his/her health, including the manifestation of symptoms of acute diseases (poisoning).
1.1.8. Treat the property and material values of the University which are provided to him/her for use in educational and other purposes, to prevent their loss, damage or deterioration.
1.1.9. Immediately inform the dean office if the student has changed adress, telephone number and other data given by students during applying to University.
1.1.10. Immediately summoned by the University administration, Intrnational medical school.
University students also have other rights and bear other obligations stipulated by the current legislation of the Republic of Kazakhstan, the Charter of the University, an agreement on the provision of educational services, these Rules and other internal regulatory documents of the University.

1.2. Financial responsibility of students.
1.2.1. In the case of students causing damage to University property or property of third parties for which the University is responsible by legislative acts or contract, the student shall be fully liable and shall reimburse the University of cause losses in the order established by the current legislation of the Republic of Kazakhstan, voluntarily or on the basis of a court decision.
1.2.2. Termination of the contract on granting of educational services between the University and students after the injury (harm) does not entail the liberation of the student from financial responsibility for damages (harm) to the University.
1.2.3. Material liability of a student for damage (harm) caused to the University is incurred for damage (harm) caused as a result of the perpetrator's unlawful conduct (actions or omissions) and the causal connection between the guilty unlawful conduct and the harm caused (damages), unless otherwise provided by the laws of the Republic of Kazakhstan.
1.2.4. The responsibility of the student for damage to University is precluded if the damage resulted from force majeure or extreme necessity, necessary defence.
Ignorance of studying law and rules, contracts and agreements, regulations and other internal normative documents and organizational and administrative acts of the University administration, does not relieve the student from responsibility and liability for damages (losses) caused by the students of the University.
1.1 Application of disciplinary sanctions for certain types of violations.
1.1.1. Absense on classes without reasonable excuse.
In the case of absense on classes without reasonable excuse, the following types of disciplinary sanctions are applied at the University for one academic year:

·                   reproof – absence from up to 18 teaching periods
·                   reprimand – absence from 18 to 45 teaching periods  
·                   severe reprimand – absence from more than 45 teaching periods

Reasonable excuse for the classes missed up should have documented confirmation by the student before a disciplinary penalty is issued. Documents submitted by students after the specified period are not considered for consideration, unless another decision is made by the administration of the University. If the student does not provide documents confirming the validity of the reasons for missing up the classes in due time, then regardless of his explanation, the reason for the pass is considered disrespectful.
1.1.2. Failure to pay on time for lessons
In case of breach of time limits for payments for the delivery of educational services stipulated in the contract, the following types of disciplinary sanctions are usually applied at the University:
Reprimand - In case of breach of time limits for payments for a period exceeding 20 working days;
Severe reprimand - In case of breach of time limits for payments for a period exceeding 35 working days;
Expulsion from the University, - In case of breach of time limits for payments for a period exceeding 55 working days.
1.1.3. Violation of academic norms while carrying out of knowledge control.
In case of violation of academic norms while carrying out of knowledge control of any forms and types during the current certification, intermediate certification, final state certification, the following types of disciplinary sanctions are applied at the University:
Serious reprimand, - At the first detection of a breach of one of the types of current knowledge control, during the intermediate certification or during the final state certification;
Expulsion from the University, - If the violation was repeated in the same type of current knowledge control or during the same period of intermediate certification or final state attestation, as well as in case of evidence of forgery or fabrication of data.
A violation of academic norms means:
(a) Copying off of somebody
The copying off of somebody means the use of any written (printed, manuscript) sources not allowed by the teacher in the course of the audit control of the knowledge (in examinations, tests or other mandatory certification activities), as well as using of technical means of communication, other methods for unauthorized obtaining information on the task.
(b) Double passing
(c) Double passing means the presentation of the same text as a different written work for passing the midterm examination of knowledge. The use of the previously prepared text as a part of a more extensive work with the teacher's consent will not be considered as a double passing.
(d) Forgery
The forgery is understood as a handing-over (presentation to the defense) by a students a compulsory written work (control, course, diploma work and other work) performed in full or in large measure by another person, as their own work, or by deliberately providing their work to another person for a consideration or for free. Deception of the examiner regarding the identity of the attested student while passing the audit control of knowledge is also considered as a forgery.
(e) Fabrication of data.
Data fabrication is understood as a formation of fictitious data or the deliberate misrepresentation of information about the data sources and the results obtained, made by the student or third parties at the request of the student, for the purpose of passing any form of knowledge control.
If any of the above violations of academic standards are found, the teacher is obliged:
To appraise the assessor as "unsatisfactory" / "0" and make a comment to him;
Not later than the next working day, to provide an official note (report) addressed to the dean of the faculty (head of the student unit), outlining the nature of the violation, the circumstances of the violation, indicating all identified participants, indicating of the amount of the borrowed text and its source, as well as the other data that can have an impact on the decision of a question about measures of a disciplinary punishment for the breacher.
If there is a fact of cheating, the teacher has the right to make an assessment of "unsatisfactory" / "0" to the student who intentionally provided his text for copying off. If there are facts of forgery or data fabrication, disciplinary measures are applied to all students, who took part in forgery or data fabrication, unless another decision is made by the administration of the University.
1.2. Grounds and order of expulsion of the student.
1.2.1. The University has the right to expel the student from the University before completing his studies on the following grounds:
(A) For the academic failure of the student, in case the student refuses from the repeated year of study.
(B) In the event of a loss of communication between the student and the University.
On the grounds of "loss of communication with the University", the student can be expelled in the following cases:
· If the student has not started the academic training in the current academic year or academic period without reasonable excuse within a calendar month from the beginning of the academic year (semester);
· If the student has not started the training sessions without reasonable excuse within a calendar month from the moment of completion of the academic leave of the student;
· If the student is absent from training sessions for no reasonable excuse for more than 30 (thirty) days in a row.
If within a calendar month from the date of the beginning of the pass or from the date when the student had to start, but did not start the studies, the student himself or through his relatives did not provide the University with a written notification of the validity of the reasons for absence in the class, the reasons for the absence are considered not valid notwithstanding the circumstances. The University has the right not to accept documents and explanations of the student, submitted after the specified period.
Reasonable excuses for missing classes should be confirmed by the student documented on the first day of appearance at the University.
(C) In connection with the transfer to another educational organization.
When the student is expelled in connection with the transfer to another educational organization, the student must timely submit to the dean's office of the relevant faculty (head of the educational unit) an application for transfer to another educational organization in the form provided by the administration of the relevant faculty (academic unit).
(D) At the student's own will, expressed in writing form, including the health status of the student on the basis of the certificate of opinion of the MCB (medical consultative board).
(E) For violation of academic norms in the cases provided in these Regulations.
(F) For violation of the terms of the contract for the delivery of educational services concluded between the student (the customer, the representative) and the University.
Under violation of the terms of the contract means non-performance and / or improper performance of obligations stipulated by the contract, including violation of the terms of tuition fees payment.
(G) For a single gross or systematic violation of the academic discipline by students.
Expulsion from the University, as a measure of disciplinary punishment, is applied to the student for a single gross or systematic violation of the academic discipline.
In all cases, regardless of the circumstances, one of the following considered as gross violation of the academic discipline:
· Violation of the University Statute;
· Presence in the classroom or at the University premises in the state of alcohol, narcotic, psychotropic toxic intoxication (their analogues), as well as the use of above-noted substances and / or their storage, distribution;
· Systematic (more than three times) smoking in the territory or premises of the University;
· Violation of sanitary and hygienic rules;
· Deliberate destruction, damage or theft of property or documents of the University, of the organizations and enterprises that have partnerships with the University, of students and employees of the University;
· Committing immoral acts that are incompatible with the status of the University student, as well as harming the authority and business reputation of the University;
· The commission of antisocial acts entailing administrative or criminal punishment;
· Dissemination of information discrediting the honor and dignity of the pedagogical worker, the reputation of the University;
· Insulting, humiliation of honor and dignity of an employee or a student of the University;
· Propaganda of racial, ethnic, religious, social intransigence and exclusiveness, the dissemination of militaristic and other ideas that are contrary to the generally recognized principles of international law and humanism;
· Organization and / or participation in unauthorized rallies and other similar events;
· Application of methods of physical, moral and mental violence towards students or employees of the University;
· Fight, disruption of lectures on the flow or in a group;
· Falsification of documents and signatures in documents (student ID, record book, library pass and others), as well as taking direct part in forging documents and signatures in documents;
· Passing exams or other forms of control of progress for another student;
· Providing students with fraudulent documents or deliberately false information related to the organization and implementation of the learning process.

Internal regulations for 2017-2018 academic year


1. GENERAL PROVISIONS
1.1.          The present Rules of the internal educational routine of the Republican state enterprise with the right of economic management "A.S. Asfendiyarov Kazakh National Medical University" of the Ministry of Health, Republic of Kazakhstan, further in text named as the University, were designed in accordance with the Regulations of the University, Laws of the Republic of Kazakhstan "About the State Enterprise", "About Education" and another normative legal acts, regulating activities of medical colleges.
1.2 The present Rules determine principles of status for students in the University, their rights and responsibilities as participants of educational relationships, establish the educational routine and code of conduct for students in the University.
1.3 Introduction of present Rules is aimed to promote enhancement of quality, effectiveness of educational activities organization in the University, safeguarding and health protection of students in the University, maintenance of discipline and order in the University and on its territory for succesfull realization of aims and goals, determined by its Regulations.
1.4. The Rules should promote the formation in students of such personal features as orderliness, responsibility, respect to their environment.
1.5. The present Rules will be placed on Unerversity's official website, corresponding information stands, in the University's library, and will be brought to the attention of all students and employees of the University in the order, established by advices and instruction of the University's President or another authorized official.

2. RULES' SPHERE OF ACTION
2.1. The Rules have a status of internal normative document of the University, and obligatory for application both for University entrants and students, irrespective of stusy types and forms.
2.2.  Violation of requirements, established by present Rules, is considered as a gross violation of educational discipline, and form basis for application to a student, who allowed a violation, disciplinary punishment.
2.3.  The present Rules form relationships in connection with educational discipline of those who is studying both in scholl time and scholl-free time;
during the presence of students on University's territory, in school and other rooms, including University's dormitory rooms;
during the presence of students on territory, in school and other rooms of any medical, educational and other organizations, having partnership relations with the University, including dormitory rooms of named organizations;
during the presence of students in basic enterprises (clinical bases), in other educational and medical establishments by the assignment of the University;
during the presence of students on conferences, seminars and other events on behalf of the University, as well as on events, arranged by the University.
2.4. Students during their presence on basic enterprises (clinical bases) or other enterprises or establishments by the assignment of the University, also should adhere to requirements of internal regulation of these enterprises or establishments.
2.5. All issues related to application of present Rules, will be decided by University's management in the framework of rights provided to it, and in the cases, provided by current law and/or University's internal normative documents, together or taking into consideration an opinion of trade-union organization of University's students.

3. CONTINGENT OF STUDENTS
3.1. University's students include all persons, enrolled to the University in accordance with established procedure as students, internees, station hearers, postgraduates,  persons working for doctor's degree, hearers of preparatory section, hearers of University's structural parts, performing professional development and retraining of specialists, for teaching in main and additional educational programs, performed by the University.
3.2. Relationships of the University and a student, his/her parents and other legal representatives are regulated by current law, present Rules and contract for educational services, which should be concluded with any student at the enrollment to the University.
3.3. At the enrollment for study, each student should conclude with the University a contract for educational services, to become familiar with University's Regulations, license for the right of educational activities, present Rules and normative legal acts, regulating the order of enrollment into educational organizations, as well as main documents on organization of the teaching and educational process in the order, established by the present Rules and administrative documents (orders, instructions) of the University's management.
3.4.   At the reinstatement of a student, leaving him/her for repeated study year, as well as at the transfer of a student from faculty to faculty, from one study form to another, from one specialty to another, the student should conclude with the University the new contract in according with the typical form, valid in the University at the moment of enrollment (reinstatement, transfer), and to pay off a financial debt to the University, if it took a place.
At that, the study worth will be determined in accordance with the price list of the University, valid at the moment of enrollment (reinstatement, transfer), if nothing other will be established by the current law and/or internal normative documents of the University (regulations, rector's orders, Academic council's decisions and others).
3.5. Connection of the University with parents (legal representatives, study customers) of students will be established through the administration of corresponding educational section, department, curators specialists in organizational and educational works.
3.6. Educational services, provided by the University to those who studies for budgetary funds in the framework of state study order, will be provided for free. Educational services above the volume of state study order will be provided by the University to students under condition of payment.
3.7. Prices for University's services, to be provided under condition of payment, will be approved by the University independently, in the order established by the current law of the Republic of Kazakhstan.
3.8. Realization of educational services above the state obligatory standards of education will be performed by the University under condition of payment.

4. RIGHT, OBLIGATIONS AND RESPONSIBILITY OF UNIVERSITY'S STUDENTS
4.1.  All categories of students have equal rights, and bear equal responsibilities, if nothing others is provided by the current law, Regulations, internal normative documents of the University and contracts for educational services concluded with students.
4.2.  Every student of the University, irrespective of study types and forms, has right to:

4.2.1. Obtain qualitative education in accordance with the state obligatory standards of education.
4.2.2. Study within the framework of state obligatory standards of education based on individual curricula, shortened educational curricula on decision of University's Academic council.
4.2.3.    Obtain additional educational services, knowledge in accordance with his/her dispositions and needs under condition of payment.
4.2.4.  Familiarize himself/herself with the present Rules and other local acts, regulating the activities of the Enterprise;
4.2.5.  Take a part in the management of the University in forms established by the current law and internal normative documents of the University.
4.2.6. Reinstate and to transfer from one educational institution to another, from one specialty to another or from one study form to another in an order, established by authorized state organ in the area of education and internal normative documents of the University.
4.2.7. Use for free information resources in the University, to be provided by textbooks, study and methodic complex and study and methodic manuals in the order established by the Government of the Republic of Kazakhstan.
4.2.8. Use for free gymnasia, reading rooms, assembly halls, library of the University.
4.2.9. Respect to human dignity, protection from any forms of physical and psychic violence, personal injury, life and health protection.
4.2.10. Encouragement and reward for academic progress, scientific and creative activities.
4.2.11. Right of conscience, information, free expression of own views and conviction.
4.2.12. Development of his/her creative abilities and interests, including participation in contests, olympiades, exhibitions, sporting events, including official sporting events, and other mass events.
4.2.13. Objective evaluation of results of his/her study activities.
4.2.14. Obtain complete and reliable information about evaluation of his/her knowledge, skill and abilities, as well as about criteria of such evaluation.
4.2.15. Address to University's administration with complaints, statements and proposals in issues related to organization of education in the University and any other issues, affecting interests of students. Complaints and proposals should be provided in written.

4.3.  Every student in the University, irrespective of study forms and types, should:
4.3.1.  Master the educational program bona fide, realize his/her individual curriculum, including visiting studies provided by the curriculum or individual curriculum, to perform the self-depenent preparation to studies, fulfill tasks, presented by teachers in the framework of the educational program.
4.3.2. To fulfill the requirements of University's Regulations, present Rules or other local normative acts in organization and realization of educational activities.
4.3.3. Observe bona fide the conditions of the educational services contract with University concluded by him/her, as well as other contracts and agreements.
4.3.4. To pay timely the cost of education price in accordance with the educational services contract (for those who learns on payment basis), in 3 (three) days provide to the administration of corresponding faculty (study department) a copy of payment confirmation.
4.3.5. Regularly familiarize with announcements and information, provided by administration of the University, faculty (study department) on informational stands in structural parts and the university library, regularly visit the University's official internet site and familiarize with information placed on the website.
4.3.6. Know and study current laws of the Republic of Kazakhstan and other normative legal acts, regulating study rules and order in colleges of the Republic of Kazakhstan.
4.3.7. Properly execute orders, advices and instructions of the administration of the University and faculty (study department) issued by them inside the limits of his/her competence.
4.3.8. Visit all types of studies in accordance with working curricula, individual study plan, study programs and schedules, not be late in studies, as well as visit consultations (pre-examination, in disciplines of intermediate state control and others), performed by University's departments.
4.3.9. If studies were missed for valid reasons, inform about it independently or through relatives the administration of corresponding faculty (study department) in maximally possible short terms, but not later than one calendar month after the day of first missed study, and in the first day of his/her appearance provide documents of necessary form (sick notes, call-up papers, letter of explanations and others), explaining a causes of absence.
4.3.10. In the fixed term to pass all types of progress control and attestation, established in the University to check progress of students.
4.3.11. Observe academic honesty.
4.3.12. Take care of maintenance and strengthening of his/her health, strive for moral, mental and physical development and self-perfection.
4.3.13. Cautiously treat personal documents of a student (student card, record-book and others), and in the case of their loss immediately inform the administration of the faculty (study department) about this.
4.3.14. Respect honor and merit of a pedagogic employee, other employees of the University, as well as persons, who is student in the University.
4.3.15.   Observe admission routine of the University, not pass his/her document providing right to admission to University's territory, to other individuals, and not use a document, issued to another person.
4.3.16.  Observe safety and preventive fire-fighting regulations, industrial saniation and personal hygiene rules.
4.3.17. Be disciplined, keep cleanness and order on territory and in University's rooms provided for general use.
4.3.18. Timely get a sanitary book and yearly pass the obligatory medical inspection in terms and order, in accordance with the order (decree) of rector or another authorized person of the University.
4.3.19. Cautiously treat the property and wealth of the University, provided to him/her to use with educational and other purpose, not allow their loss, damage or spoiling.
4.3.20. Immediately inform the administration of corresponding faculty (study department) in the case of any change of address, phone number and other data, provided by students at the admission to the University.
4.3.21. Report immediately upon a call of the administration of the University, faculty (study department).
4.3.22.  Students of the University also have another rights and bear another responsibilities, provided by the current law of the Republic of Kazakhstan, University Regulations, educational services contract, present Rules and other internal normative documents of the University.


4.4. Material liability of students
4.4.1.  If a student causes any loss to property of the University as well as third persons, for which the University is responsible based on legislative acts or a contract, then the student bears full material liability and compensates any losses caused to the University in an order, provided by the current law of the Republic of Kazakhstan, bona fide or based on court decision.
4.4.2. Termination of the education services contract between the University and a student after causing a loss (damage) doesn't entail exemption of a student from the material liability in compensation of caused loss (damage) to the University.
4.4.3. Material liability of a student for a loss (damage) caused to the University, comes for a loss (damage), caused as a result of guilty unlawful conduct (action or inaction) and casual relationship between guilty unlawful conduct and caused loss (damage), if nothing different is provided by the laws of the Republic of Kazakhstan.
4.4.4. Reliability of a student to a loss, caused to the University, will be excluded, if this loss occurred as a result of Act of God or extreme necessity, necessary defence.
4.4.5. If a student lacks knowledge of current law provisions, contracts and agreements concluded by him, present Rules and other internal normative documents and organizational and regulation acts of University administration, this doesn't exempt a student from liability and responsibilities in compensation of a loss (damages), caused by a student to the University.

5. ENCOURAGEMENT MEASURES FOR ACADEMIC PROGRESS
5.1.  For the perfect and good results, success in scientific and creative activity, active participation in scientific research, in athletic, sporting and social life of the University, following encouragement measures will be provided for students:
·                   announcement of gratitude;
·                   rewarding a deed;
·                   providing an exhibition;
·                   a raise of the study grant;
·                   providing of a discount to the payment for study;
·                   recommendation for the enrollment to magistracy;
·                   assignment to a foreign college;
·                   placing of a student's photo on the Table of honor;
other types of encouragement, provided by internal normative documents of the University.
5.2. Order of application to students of encouragement measures will be determined by the current law of the Republic of Kazakhstan and internal normative acts of the University.
5.3. Encouragement will be declared by rector's order based on declaration of faculty dean (manager of study department) and will be brought to notice of students (group, faculty) on the meeting. Copy of the order or extract of the order about encouragement will be stored in personal records (personal card) of a student.
5.4. To parents of perfectly progressing, disciplined, successful in scientific research, sporting, cultural, social work students will be sent notes of thanks from University's rector (prorector, faculty dean (manager of study department).

       6. RESPONSIBILITY OF STUDENTS FOR STUDY DISCIPLINE VIOLATION
6.1. For purposes of present Rules, as "disciplinary case" will be understood the violation of study discipline by a student, expressed in unlawful guilty non-execution and/or unduly execution of responsibilities, provided by normative legal acts of the Republic of Kazakhstan, regulating education process, by the University Regulations, present Rules and/or contract for presentation of education services.
6.2. For perpetration of a disciplinary case in the University, following types of disciplinary punishment will be applied to a student:
·                   reproof;
·                   reprimand;
·                   severe reprimand;
·                   demissal from the University.
Use of a disciplinary punishment, not provided by the present Rules, is not allowed.
6.3. The right to apply and choose measures of disciplinary punishment belongs to University's rector, pro-rectors, deans of faculties (managers of study departments), taking into account measures of disciplinary punishment which were applied to a violator earlier, degree of violent's guilt, severity of the offence, previous and following behavior of violator, his/her attitude to study as well as taking into account conditions which were a cause of violation and conditions, under which it was committed.
6.4.  Order of application and appeal for disciplinary punishments
6.4.1. Disciplinary punishment in the form of "reproof" and "reprimand" will be announced by faculty dean (manager of study department) in verbal form.
6.4.2. Disciplinary punishment in the form of "severe reprimand" will be applied by issue of corresponding order by the rector or another authorized official of the University based on motivated statement of a manager of corresponding study department.
6.4.3. The right to apply disciplinary punishment in the form of "dismissal from the University" belongs exclusively to the rector of the University.
6.4.4. For each disciplinary case, only one disciplinary punishment can be applied to a student.
6.4.5.  If a student commits disciplinary case, the dean of corresponding faculty (manager of study department) provides to the name of pro-rector for curation and University rector a memorandum, mentioning student's full name, course of study, faculty (study department), nature of violation committed by a student, type of proposed reprimand and justification of its application.
6.4.6. To the memorandum should be added documents and materials, confirming the fact of disciplinary case commitment by a student, and justifying the application of one or another type of disciplinary punishment.
6.4.7. If a student commits disciplinary case, causing the application of such disciplinary punishment as "severe reprimand" or "dismissal from the University", the dean of corresponding faculty (manager of study department) composes the Act about violation of study discipline, which should contain following obligatory data:
·                   serial number;
·                   date and place of Act composition;
·                   full name, faculty, study course, group number of a student(s) who committed the disciplinary case;
·                   names and positions of University employees signing the Act;
·                   date of the disciplinary case committed by student(s);
·                   nature and short description of committed disciplinary case;
·                   facts confirming commitment of the disciplinary case.
6.4.8. To the Act should be added documents confirming the fact of disciplinary case commitment by student(s), which could include:
Memorandums from departments, written explanations, reports from students, University employees about circumstances, known to them, which are of importance for examination of the issue about disciplinary punishment application;
acts, documents, letters, containing information on circumstances, which are of importance for examination of the issue about disciplinary punishment application.
Documents also can include materials with computer information, photo, audio and video recording.
6.4.9. Faculty (study department) administration) can initiate the examination of the issue about disciplinary punishment application on the council of dean's office (faculty, study department) and/or by a representative organ of students. In this case, to the report of study department manager, the protocol of council's meeting will be attached, signed by council's head and secretary and/or decision of a representative organ of students.  
6.4.10.  Prior to application of disciplinary punishment to a student, faculty (study department) administration should require written explanation from a student about the nature of violation committed. Student's denial to provide written explanation, equally the failure to provide written explanation because of his/her absence in study or failure to appear after the call of dean's office (study department) cannot be an obstacle in application of disciplinary punishment. In this case, commission formed by faculty dean (study department manager) composes corresponding act. Commission will be formed from at least three persons from the number of faculty (study department) employees and teachers. Commission can include students from the group, in which a student is registered, who committed this disciplinary case.
6.4.11. In necessary cases, faculty (study department) administration has right to perform an official inquiry into the incident engaging, if necessary, law-enforcement authorities, or checking of facts, provided in the written explanation of a student.
6.4.12. If any facts will be discovered that a student committed misdeeds, for which the current law provides the criminal liability (theft, robbery, damaging human health, barratry, forgery of documents etc.), the faculty dean (study department manager) should immediately inform pro-rector for curation, manager or leading specialist of the Legal department to make a decision about reference to law-enforcement authorities.
6.4.13. The order about recovery of penalty to a student cannot be issued during:
·                   temporary disability of a student;
·                   vacation;
·                   a student is in the study leave.
6.4.14. The order about recovery of disciplinary penalty will be announced to a students being a subject of disciplinary penalty against his/her signature during five days after the day of its issue. If a student denies to confirm with his/her signature the familiarization with the order, corresponding record will be made in the order about recovery of disciplinary penalty.
6.4.15.   If it is impossible to familiarize a student with the order about recovery of disciplinary penalty in person, the administration of corresponding faculty (structural section) should send the order to a student by a registered letter to address provided in his/her personal card.
6.4.16. If a student does not agree with the order about recovery of disciplinary penalty, this student has right to appeal against this order in the sequence established by current law of the Republic of Kazakhstan and present Rules.
6.4.17. Copy of the order or extract from the order about recovery of disciplinary penalty is stored in the personal case (personal card) of a student.
6.4.18. Application of the disciplinary punishment is not an obstacle to charge to a student the responsibility to compensate a loss caused by him/her to the University, as well as to apply other measures of material or moral influence, not prohibited by the current law of the Republic of Kazakhstan.

   6.5.  Terms of disciplinary punishments application
6.5.1. Disciplinary punishment will be applied not later than one month after discovery of misconduct, and not later than six month after it was made, excluding time of disease of a student and (or) his/her presence in vacation or in study leave.
6.5.2.  As a day of discovery of disciplinary case will be considered a day when a person to which a student is subordinate, became known of misconduct, regardless of that, if it has a right to apply disciplinary punishments. If a student made a prolonged violation, one-month term will be calculated from the day of last violation.
6.5.3. Duration of disciplinary punishment cannot exceed one year from the day of its application, excluding the case of dismissal of a student based on causes, provided by the present Rules. If during this period a student will not undergone a new disciplinary punishment, he/she will be considered as not having any disciplinary punishment.
6.5.4. University rector has right to remove punishment from a student ahead of schedule at the instance of student or manager of corresponding faculty (structural section), as well as on request of representative organ of students.

6.6.  Application of disciplinary punishments by separate types of violations
6.6.1.  Absence from studies without valid reasons
In the case of absence from studies without valid reasons during one year, following types of disciplinary punishments will be applied in the University:
·                   reproof – absence from up to 18 teaching periods
·                   reprimand – absence from 18 to 45 teaching periods  
·                   severe reprimand – absence from more than 45 teaching periods
6.6.2.  Violation of study payment terms
If a student violates study payment terms provided by the educational services contract by more than 55 working days, dismissal from the University is provided.
6.6.3.  Violation of academic honesty during the knowledge examination
If a student violates academic honesty during the knowledge examination of any forms and types during ongoing attestation, intermediate attestation, final state attestation, following types of disciplinary punishments will be applied in the University: 
- reprimand – at first discovery of academic honesty violation in the period of intermediate attestation or in the period of final state attestation;
- severe reprimand – at repeated academic honesty violation in the period of intermediate attestation or in the period of final state attestation;
- dismissal from the University – at third discovery of academic honesty violation in the period of intermediate attestation or final state attestation.
If any facts of forgery or data fabrication are found, a student should be dismissed from the university.
As academic honesty violation by a student will be understood:
(a)          Cribbing
As cribbing for purposes of present Rules will be understood usage by a student when passing auditory knowledge examination (in examinations, tests and other obligatory attestation events) of any written (printed, hand-written) sources, not allowed by teacher, as well as usage of technical connection means, other ways to obtain surreptitiously any information related to a task to be performed by student.
(b)          Plagiarism
As plagiarism for purposes of present Rules will be understood usage in a written work of foreign text, published in paper or electronic form, without complete reference to a source, or with references, but when the volume and nature of borrowing bring into question independence of performed work or any of its main parts, regardless of the type of plagiarism. Questions of copyright and allied rights violation will be not regulated by present Rules.
Plagiarism can be made in two ways:
literal statement of others' text;
paraphrase – statement of others' text with replacement of words and expressions, without replacement of content of the borrowed text.
(c)          Double pass
As double pass will be understood the presentation of same text as different written works to pass the border knowledge examination. As double pass will be not considered the use of a text prepared earlier as a part of more extensive work under teacher's approval.
(d)          Forgery
As forgery for purposes of present Rules will be understood the pass (preparation to defence) by a student of obligatory written work (control, course work, diploma thesis and any other work), made completely or in significant part by another person, as own work, or deliberate presentation of own work to another person for reward or for free.
As forgery also will be understood false representation to examiner of person of a student to be attested when passing the auditory knowledge control.
(e)          Data fabrication
As data fabrication for purposes of present Rules will be understood the formation by a student or third persons of false data or deliberate fraudulent misrepresentation of data sources and obtained results with the aim of passing any forms of knowledge control.
At the discovery of any of above-mentioned academic norms violations, the teacher should:
mark a student as "unsatisfactory"/"0", compose the Act of violation of academic honesty rules and eject from the examination;
not later than the next working day provide a memorandum (report) to the name of faculty dean (study section manager) with the statement of the nature of violation, circumstances of misconduct, indication of all identified participants, indication of volume of borrowed text and its source as well as other data being important to make a decision about application to students allowed a violation of disciplinary punishment measure.
To the report will be attached a copy of student's work or its part containing a violation. Original of student's work will be stored in the chair which provides this discipline until the end of official period of retakes for this discipline.
If the fact of cribbing is discovered, teacher has right to set a mark "unsatisfactory"/"0", to a student, who intentionally provided his/her text for cribbing.
If any facts of forgery or data fabrication are discovered, disciplinary punishment measures will be applied to all students participants of forgery or data fabrication, if another decision will not be taken by University rector.
If any facts of forgery or data fabrication are discovered, teacher should invite witnesses from teachers, students or other persons in the number of at least 2 individuals, fix the fact of violation by corresponding act, attaching in necessary cases photo and video recordings, eject from a student documents, evidencing the fact of forgery and data fabrication, and immediately inform a faculty dean (study section manager).

     6.7. Grounds and order of student's dismissal
6.7.1. The University has right to dismiss a student from the University before he/she finishes the study based on following grounds:
(a)          For academic failure of a student, in the case of student's denial from repeated study year.
Student's denial from repeated study year should be fixed in written form by presentation of correspong statement from a student to the name of University rector.
If during one calendar month from the date of study year beginning the student hasn't provided an application for denial from repeated study year, at that doesn't concluded with the University the educational services contract and didn't paid the study cost, University has right to dismiss him/her as one who denied repeated study year, regardless of causes and explanations of student.
(b)          In the case, if the student loses connection to the University
The student can be dismissed due to "loss of connection to the University" in following cases:
if the student didn't started his/her study in current study year or academic period without valid reasons during one calendar month from the date of study year (term) beginning;
if the student didn't started his/her study without valid reasons during one calendar month from the end of academic leave of the student;
if the student is absent from studies without valid reasons for more than 30 (thirty) days in a row.
If during one calendar month from the starting date of absence from study or from date, when a student had to start, but not started his/her study, and a student by himself/herself hasn't provided to the University a written statement about validity of reasons to be absent from study, then reasons of absence will not considered valid regardless of circumstances. The University has right not to accept documents and explanations of a student, provided after presented date.
Valid reasons of absence from study should be confirmed by a student documentary at the first day as he/she visits the University.
At the dismissal of a student with the ground "loss of connection to the University", the student and/or his/her legal representatives should be notified about necessity to provide explanations of a fact of student's absence from study by verbal warning by phone and sending a written notification to the address, provided in the personal card of a student not later than 7 (seven) working days from the date of the issue of University rector's order about dismissal. Nonreceipt by a student/legal representative of this notification due to non-corresponding phone number and address provided in the personal card of a student with actual phone number and address of a student/legal representative or other causes, is not an obstacle in student's dismissal.
(c)          Due to transfer into another educational enterprise
If a student will be dismissed due to transfer into another educational enterprise, this student should timely provide to the dean's office of corresponding faculty (to study section manager) his/her application on the transfer into another educational enterprise using the form provided by the administration of corresponding faculty (study section).
(d)          On student's own wish, expressed in written, including due to health status of a student, based on reference from MCC (medical and consultation commission)
If a student will be dismissed on his/her own wish, such student should timely provide to the dean's office of corresponding faculty (to study section manager) his/her application on unsolicited dismissal with indication of causes (health status, family status, others).
Unsolicited dismissal will be done in a period not exceeding 20 (twenty) days from providing of application by a student. Date of dismissal is the dte of providing by a student of application on dismissal, or date, provided directly in student's application, depending on what comes later.
If a student provides application on dismissal not in time, the obligation of a student (representative, customer) to pay for study maintains until the date of student's dismissal provided in the order of University rector.
(e)          For academic honesty violation by a student in cases provided by the present Rules
(f)           Vor violation by a student of provisions of educational services contract concluded between a student (customer, representative) and the University
As contract provisions violations will be understood non-execution and/or improper execution of responsibilities provided by the contract, including violation of study payment terms.
(g)          For single severe or systematic violation of study discipline by a student
Dismissal from the University as a measure of disciplinary punishment will be applied to a student for single severe or systematic violation of study discipline.
In all cases, regardless of circumstances, to severe violation of study discipline belongs any of following violations:
·                   University Regulation violation;
·                   presence in study or University rooms in the condition of alcoholic, drug, psychotrope, toxicomaniac intoxication (or their analogues), as wel as consumption of named substances and/or their storage/distribution;
·                   systematic (more than three times) smoking on the territoty or in rooms of the University;
·                   violation of sanitaric and hygienic rules;
·                   deliberate termination, damage or theft of property or documents of University, organizations and enterprizes having partner relations with the University, students and employees of the University;
·                   immoral conduct, incompatible with the status of University student, as well as affecting University's authority and goodwill;
·                   anti-social acts causing administrative or criminal penalty;
·                   distribution of information detractive to honor and merit of pedagogic employee, University's reputation;
·                   offence, derogation to pedagogic employee, or University's student;
·                   propaganda of racial, ethnic, religious, social irreconcilability and exclusiveness, distribution of militaristic and other ideas, conflicting with generally recognized principles of international right and humanity;
·                   organization and/or participation in unsanctioned meetings and other similar events;
·                   application of physical, moral and psychical violence to students or University employees;
·                   fight, breakdown of study in the stream or group;
·                   forgery of documents and signatures in documents (student card, record-book, library ticket and other), as well as direct participation in forgery of documents and signatures in documents;
·                   passing an examination or another forms of progress control for another student;
·                   providing students with counterfeit documents or knowingly false information related to organization and performance of the study process.
To systematic violation of study discipline by a student belongs repeated (two and more cases) performance of disciplinary cases during one academic year.
Should any cases of consumption and distribution of drug substances will be found, appearance in the University building in a state of intoxication, violation with respect to another persons, extortion, participation and propaganda of ideas of religious groups having non-traditional direction (totalitarian sects, destructive cults, extremist parties), a student will be dismissed from the University without the right to recovery, if no other decision will be taken by University rector.
(h)          In other cases, provided by current law, educational services contract concluded between student and University, present Rules and other internal normative documents of the University.
6.7.2. Dismissal of a student from the University will be performed by issuing of corresponding order by University rector.
6.7.3.  From the date of dismissal of a student provided in the order about dismissal, the educational services contract concluded between student and University, is considered as terminated, without additional confirmation by student and University.
6.7.4. At the dismissal from the University, a student at his/her inquiry obtains academic certificate-transcript of fixed form, certificate-confirmation about the study in the University, original of a document about the education and other documents, being in the personal case of a student.
At the dismissal due to transfer to another college, the University in 3 (three) days after obtaining the inquiry of receiving college sends to receiving college the personal case of a student. Copy of personal case is stored in the University.
If a student has financial debt against the University, the University maintains the right to delay the issue of student's documents about education, study in the University and other documents, containing in the personal case of a student, until the complete compensation of financial debt.
6.7.5.  Personal responsibility for timely application of disciplinary punishments and duly registration of corresponding documents to be charged on deans of faculties (study department managers).

    7. ORDER IN ROOMS AND ON TERRITORY OF THE UNIVERSITY
7.1.  Deans of faculties (study department managers) and group monitors are responsible for the order in study auditories during studies.
7.2.   In rooms and on the territory of the University is prohibited:
(a)         to bring and to drink alcohol, alcohol-containing drinks and beer, to be in the alcoholic, drug or toxic intoxication, their analogues, commit another acts, for which the current law provides the administrative responsibility;
(b)         to bring explosives, highly inflammable and toxic substances, firearms, gas and cold arms (except for cases, when a license for its carrying is present because of performance of duties);
(c)         to play cards;
(d)         to play sport games outside specific places provided for that (sports grounds), except for conducting in the established order of organized mass sports and entertaining events;
(e)         to smoke on the territory of the University;
(f)         to use obscenities and to perform any other anti-social behavior;
(g)         to violate sanitary and hygienic rules and norms;
(h)         to put on walls, auditory tables and in another places any writings and pictures, to stick and hang out announcements without approval of University administration;
(i)          to spoil the property of the University or to misuse it, to perform any actions, affecting cleanness and order;
(j)          to cry, make a noise, play music and perform any actions when spoiling the silence and creating disturbances to performance of the study process;
(k)         to use of loudspeakers and sound-reproducing equipment (except for coordinated cases of performed events);
(l)          to be in rooms of the University in outer clothing, hats;
(m)       to be in study auditories and laboratories at the time, not taken by schedule of studies of his/her academic group;
(n)         to block up passageways, to create obstacles for movement of people and cars;
(o)         to use mobile connection means during studies, examinations and other official events;
(p)         to move from one room to another without permission of administration or financially responsible persons of the University any furniture, equipment and other wealth;
(q)         to carry out any property of the University without permission of administration from auditories, reading, dining and other rooms;
(r)          to move in the rooms of the University using bicycles, roller skates and boards and other similar means of transporting and sporting function;
(s)         to perform movie, photo and video recording in classified and isolated rooms of the University, as well as professional movie, photo and video recording in rooms and on territory of the University without permission of the administration;
(t)          to perform movement and parking of cars and motorcycles on territory of the University outside places specifically classified for this purpose.

    8. ADMISSION ROUTINE
8.1. In the University, following routine of work will be established.
(a)         Stay of students in the University is allowed:
at working days from 7:30 till 22:00;
at Saturday from 7:30 till 21:00.
(b)         Admission to territory of the University will be discontinued:
at working days at 21:00;
at Saturday at 19:00.
8.2.  Routine of work of University dormitories will be established by corresponding internal documents of the University, regulating rules and order of living in dormitories.
8.3. In holidays and weekends as well as in emergency situations, in rooms of the University, including living and domestic buildings, special working regimen of work and property usage can be set, also can be introduced duties of responsible worker on the basis of the order of University rector.
8.4. Routine of work for structural departments of the University and admission routine prior to holidays and during excluded holidays will be established by rector's order.

     9. FINAL PROVISIONS
9.1. Modifications and amendments to the present Rules will be introduced by orders and directions of University rector or in form of issue of a new edition of the Rules.
9.2. In the case of variant readings between the text of present Rules and modifications and amendments to present Rules, prevalence have documents approved by latest date, but only in the limits of introduced modifications and amendments.
9.3. Under any circumstances student conditions, provided by current law of the Republic of Kazakhstan, have prevalence. In the case of discrepancy of the present Rules or separate provisions provided by the present Rules with the requirements of the current law, the norms of the current law of the Republic of Kazakhstan will be applied.
9.4.  The Rules come into force from the moment of their approval by University rector, and are valid for indeterminate time (until approval of new Rules).
